1 - CONDITIONS OF APPLICATION
The present general conditions of sale apply to all sales made on the website www.arthur.fr and govern the relationship between, on the one hand,

Hereinafter referred to as "the user".

Any purchase made on the ARTHUR website implies full acceptance of these general conditions of sale. The user must have read the general terms and conditions of sale of the "ARTHUR" site before validating an order. By validating his/her order, the user accepts these general terms and conditions of sale in their entirety.

ARTHUR reserves the right to modify these general terms and conditions of sale at any time.


2 - INFORMATION ON THE PRODUCTS

In accordance with Articles L 111-1 and L 113-3 of the French Consumer Code, the essential characteristics and prices of products sold electronically are available on the www.arthur.fr website or in ARTHUR's retail outlets.


In addition, the customer receives the information provided for in Article L 121-19 of the Consumer Code, before and after the conclusion of the sale and in particular by these general conditions of sale which he declares to have read before the validation of his order and to which he has access from the site www.arthur.fr and by reference in the e-mails confirming and sending his order which are sent to him.


2JDL makes every effort to ensure that the prices displayed on the Site are accurate and that all products are correctly described. Nevertheless, when placing orders for products on the Site, it is specified that :

- the weights, measures, sizes and capacities indicated on the Site are only given as an approximation;
- the actual colours of the products, the colours that the customer sees will depend on the computer screen used and the display configurations and it cannot be guaranteed that the colour display by the screen corresponds exactly to the colour of the products that the customer will receive;
- although 2JDL ensures that all products match their description on the Site, changes in manufacturing processes, computer screen configurations and hardware may affect the appearance of fabrics and product designs, which means that products delivered may differ slightly in appearance from the presentation on the Site.


3 - PRICES

All prices indicated on the product sheets and the order form are given in euros, including all taxes.
The prices indicated do not include delivery costs which are extra. The rate of delivery costs is shown on the order form. The order confirmation will be sent by e-mail.
www.arthur.fr reserves the right to modify its prices at any time but undertakes to apply the prices in force at the date the user places the order.


4 - ORDER AND PAYMENT


The order will only be final after receipt of the order confirmation by www.arthur.fr by means of an e-mail sent to the e-mail address indicated by the user when opening his/her account. No orders will be processed on weekends and public holidays.

All our articles are offered for sale while stocks last. The availability of the articles will be validated by the confirmation of the order which will be sent to the user by e-mail.
Payment for your order can be made by credit card (Visa, MasterCard, Carte Bleue), PayPal or Amazon Pay. The order will only be processed upon receipt of payment.
The order confirmation sent by www.arthur.fr will summarise the total price of the order including all taxes. The commercial invoice will be downloadable from our website www.arthur.fr and will remain available for consultation.

Payments by credit card over 30€ are authenticated thanks to the 3-D Secure system. After validation of your bank details, you will receive a notification on your bank's application. You will then be able to identify yourself using a password or your fingerprint. Once the authentication is validated, your order is finalized: you will receive a confirmation e-mail. For any question concerning the 3-D Secure, we invite you to contact your bank directly.

5 - DELIVERY


www.arthur.fr delivers to the following countries: France, Andorra, Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Guadeloupe, French Guyana, Hong Kong, Ireland, Israel, Italy, Japan, Latvia, Lebanon, Liechtenstein, Lithuania, Luxembourg, Malta, Mexico, Monaco, Morocco, Netherlands, Norway, Poland, Portugal, Republic of Korea, Reunion Island, Romania, Singapore, Slovakia, Slovenia, Spain, Sweden, Switzerland, Ukraine, United Kingdom, United States
From the date of receipt of the payment, the order will be shipped within 48 to 72 hours. Orders are not processed on weekends and holidays.
Our deliveries are carried out by the POST office in Colissimo Suivi (delivery under 48H00 after deposit of the parcel at the post office) and/or Chronopost (delivery under 24H00 after deposit of the parcel at the post office).
If the delay in delivery exceeds 30 working days after the deadlines indicated at the time of the order, the user will be entitled to cancel the order and request a refund in accordance with Article 7.
Orders are delivered to the user at the delivery address mentioned on the order form. In case of absence of the user, a notice of passage will allow him to withdraw his parcel in the post office nearest to his residence in the 10 days after deposit of this notice. We encourage the user to have the parcel delivered to their place of work.

Free delivery for all orders over 110 euros, in France and in 22 countries abroad. For deliveries outside the European Union, including Switzerland, customs fees may be applied and will be charged to the customer.

6 - LOYALTY PROGRAM
Allocation of loyalty points
As soon as you make your first purchase, you are enrolled in the loyalty programme. This loyalty programme allows points to be accumulated (1 point = 1 euro) for each purchase made on the www.arthur.fr website.
The accumulation of points allows the user to benefit, within the limit of their validity, from discounts valid for the next purchase, according to the following scale: 200 points = 10 euros

Use of the vouchers
The value of the voucher is €10.
The vouchers cannot be split (use of the voucher in its entirety and applicable to an order amount equal to or greater than 10 Euros excluding shipping costs), and will be valid for 1 year. Vouchers are personal and may not be used by a third party under any circumstances.
In the event of a dispute over the number of points acquired by the user, only the information contained in the www.arthur.fr file is valid.

Sponsorship
The €8 voucher is generated when the sponsored person has placed an order on www.arthur.fr. The voucher is valid for 1 year and must be used by the sponsor only and in one go.


7 - RIGHT OF WITHDRAWAL

7.1 - Withdrawal period

Pursuant to Article L.221-18 of the French Consumer Code, the Customer has the right to withdraw from the contract within 14 days of delivery of the Product.

At the end of the above period, the Products may only be reimbursed within the framework of the application of the legal guarantee of conformity and/or hidden defects in accordance with articles L.217-4 et seq. of the Consumer Code and articles 1641 et seq. of the Civil Code.

7.2 - Notification of withdrawal

In order to exercise his right of withdrawal, the Customer must inform 2JDL SAS of his wish to withdraw before the expiry of the aforementioned period of 14 days, by means of the withdrawal form made available to him (the model of which is inserted below in the Appendix) or by means of any other unambiguous statement.

7.3 - Return - Exchange - Refund

Benefit from free returns in metropolitan France


METROPOLITAN FRANCE:

Arthur products can be returned free of charge within 30 working days.

For all exchange or refund requests, please ensure that the items are intact, in their original packaging with the labels attached to the product. Please have your order number AR-00000 or your tracking number ready

1 - Click on the link: ONLINE RETURN SERVICE

2 - Once you have made your declaration, you will receive your return label by email. Print it out and stick it on your parcel, which must be securely closed.

3 - Send your parcel back to us by La Poste or Relais Colis and keep your proof of deposit.

Once your return is received, the returned products will be exchanged or refunded within 14 working days.



RETURN TO LETTERBOX

Drop your parcel in your letterbox. Follow these steps:

1 - Go to: https://www.laposte.fr/particulier/retourbal/formulaire

2 - Fill in your 13-character parcel number, starting with "8R...". This number is located on the return label under the first barcode.

3 - Place your parcel in your letterbox to be collected the following day.

For all exchange or refund requests, simply return your item in a securely sealed package, along with your full contact details to the following address:

Once your return has been received, the returned products will be exchanged or refunded within 14 working days.

ARTHUR does not cover the cost of returns outside metropolitan France.

Pursuant to the decree of 18 November 2014 relating to the law n°2014-344 of 17 March 2014, 2JDL - 176 rue d'Estienne d'Orves - 92702 Colombes cedex - France - is the guarantor of the conformity of the goods sold and states that:

> When acting under the legal guarantee of conformity, the consumer :

- has a period of 2 years from the date of delivery of the goods in which to act;
- may choose between repairing or replacing the goods, subject to the cost conditions set out in Article L. 217-9 of the Consumer Code;
- The defects of conformity which appear within twenty-four months of the delivery of the good are presumed to exist at the time of delivery, unless proven otherwise.

> The legal guarantee of conformity applies independently of any commercial guarantee that may have been granted.

> The consumer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code and, in this case, he may choose between the resolution of the sale or a reduction in the price of the product in accordance with article 1644 of the civil code.


8 - PROTECTION OF PERSONAL DATA
In order to process the user's order, the collection of personal information is mandatory and remains confidential. In application of the law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms, the consumer has a right of access, rectification and opposition to the personal data concerning him. The processing of nominative information of users set up by 2JDL has been declared to the CNIL.


9 - RESERVATION OF OWNERSHIP
The sales are concluded with reserve of property. The products bought on the site www.arthur.fr remain the property of www.arthur.fr until the complete payment of the price.

 

10 - INTELLECTUAL PROPERTY
The Arthur brand, the illustrations, the logos, the drawings and models appearing on the site are the exclusive property of the company 2JDL. Any total or partial reproduction, without the express and prior agreement of the company 2JDL, is strictly forbidden in application of articles L 335-2 and L 335-3 of the code of intellectual property and constitutes an infringement and an offence.


11 - ECO ORGANISATIONS

Please note that we are registered with the eco-organism and up to date with our eco-contributions under the following unique identifiers:

- FR272446_01ZHYJ , issued by ADEME and communicated by CITEO, whose objective is to facilitate the monitoring and control of compliance with EPR (Extended Producer Responsibility) packaging obligations;

- FR219370_11XVCN, issued by ADEME and communicated by Re_fashion, whose objective is to facilitate the monitoring and control of compliance with EPR obligations (Extended Producer Responsibility) for textiles, shoes and household linen.


12 - RESPONSIBILITY

These General Terms and Conditions of Sale are governed by French law, subject to the application, for consumers domiciled abroad who may be recipients of Products, of international public policy provisions specifically protecting them.

In the event of a dispute related to the application and/or interpretation of these general terms and conditions of sale, the Customer has the possibility of resorting to a conventional mediation procedure or to any other alternative method of dispute resolution when a dispute is likely not to be settled directly with 2JDL SAS. The dispute may be the subject of an amicable settlement by mediation with the Centre de Médiation et d'Arbitrage de Paris ("CMAP") subject to the conditions set out in Article L612-2 of the Consumer Code.

To submit a dispute to the consumer mediator, the customer can fill in the form on the CMAP website (www.mediateur-conso.cmap.fr), send his request by simple or registered mail to CMAP - Service Médiation de la consommation, 39, avenue F.D. Roosevelt, 75008 PARIS), or send an email to consommation@cmap.fr.

In all cases, the Customer's request must contain the following elements: his postal, email and telephone contact details as well as the full name and address of the company 2JDL SAS, a brief statement of the facts, and proof of the prior steps taken with the ARTHUR site.

The Customer is also informed of the possibility of referring to the Online Dispute Resolution (ODR) platform provided by the European Commission and accessible at the following address: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=FR.
